San Diego Sheriffs Confiscating Guns

Check out the article below. The San Diego County Sheriff’s Department is now engaging in door to door firearms confiscation. We’ve always dreaded the knock on the door with the police saying, “We are here to confiscate your firearms.” People, it’s happening.

The article says a little, but it doesn’t say a lot. I would be interested in the search and seizure issue. If the person whose home is being searched is on probation or parole then that’s one issue, the government will check. However, if they ever come to your door asking, “Can we come in and check?” The answer is always, “No.” They might threaten to get a search warrant, let them get one.

They might try this, “The courts look favorably upon people who cooperate.” The truth is, courts are very protective of individual constitutional rights and they have no problem with somebody exercising their rights. Courts do not like seeing badge heavy cops who throw their authority around and use intimidation tactics

The officers might say, “What do you have to hide?” The answer is, “I have nothing to hide, go and get a warrant.”

If they are at the front door, never step outside. “Sir, can you step outside?” The answer is “No, I’m fine where I am and you are fine where you are.” If it gets pretty ugly and argumentative, wish them a good day and walk away.

If they want to talk to you and say, “You are not under arrest and are free to leave at any time.” They are doing that in order to trick you into making a confession. When they tell you that you are free to leave, then leave. If they do not allow you to leave, you have been placed under arrest even though they haven’t said so. Courts have consistently held this.

Demand to know everybody’s name who was present, demand to know the name of their supervisor.

If they take anything, demand a receipt.

Take care and exercise your rights.

REGION: 13 felony arrests made in North County firearm compliance check

NORTH COUNTY ---- A three-day compliance check of people banned from having firearms resulted in 13 felony arrests, an Escondido police spokesman said Saturday.

Members of law enforcement fanned out across Escondido , Vista and Oceanside on Tuesday, Wednesday and Thursday to check 39 homes of people prohibited from having guns because of convictions for domestic violence, weapons violations or any felony, Escondido police Lt. Bob Benton said.

During the sweep, 16 firearms were recovered, Benton said. An immigration hold was also placed one of the people arrested.

The operation included members of the Escondido Police Department, the Oceanside Police Department, the Sheriff’s Department, the North County Gang Task Force, county probation, state parole, the Bureau of Alcohol, Tobacco and Firearms and the U.S. attorney’s office.
